What is the difference between a settlement agreement and a compromise agreement?

There is no difference. Settlement Agreements (previously known as compromise agreements) are used when an employee and employer want to come to an amicable solution and avoid tribunal proceedings. A settlement agreement is sometimes referred to as a “golden handshake.” Negotiating this fairly is essential to keep both the employer and employee happy – but, very often, this negotiation doesn’t take place.

How we can help you with your Settlement Agreement

For Employers:

  • Draft a Settlement Agreement for you, taking into account the facts of the workplace related matter and the seniority of the employee
  • Ensure you are protected
  • Advise you on the terms of Settlement Agreement and ensure that you are satisfied with the amount offered to the employee
  • Negotiate a fair settlement agreement with your employee

For Employees:

  • Negotiate a settlement for you
  • Advise you on the terms of the Settlement Agreement and, if necessary, negotiate  any terms
  • Provide you with clear and pragmatic advice as to whether you have any potential claims
  • Advise you on whether you are getting a “good deal”

Benefits of a Settlement Agreement

For Employers:
A settlement agreement ensures that employers would not have to face any legal action in relation to any dispute in the future from their departing employee and can help them avoid a public employment tribunal claim.

For Employees:
Settlement Agreement includes an agreed settlement sum for employees which they would receive from their employer if they agree to not pursue any employment tribunal proceeding against their employer.  They can also negotiate a reference.
